a) The business relationship between you, the customer, and us, Mount Med Resort Betriebs GmbH, concerning the purchase of goods offered via the Mount Med Resort Betriebs GmbH online shop, shall be governed exclusively by the following General Terms and Conditions (GTC) as valid at the time the order is placed.<\/p>\n

b) For the purposes of these GTC, \u2018goods\u2019 shall refer to all products available for purchase through the Mount Med Resort Betriebs GmbH online shop.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>2. Conclusion of Contract<\/span><\/a><\/div><\/div>

a) The presentation of goods in the Mount Med Resort Betriebs GmbH online shop does not constitute a binding offer to conclude a contract, but rather serves as a non-binding invitation for you to submit an order.<\/p>\n

b) Orders may only be placed by individuals who have reached the age of majority. Goods are supplied solely to end consumers and only in quantities customary for household use.<\/p>\n

c) You may select goods from the Mount Med Resort Betriebs GmbH online shop and add them to your shopping basket by clicking the \u2018Add to cart\u2019 button. By clicking the \u2018Buy\u2019 button, you are submitting a binding offer to purchase the goods contained in your shopping basket.<\/p>\n

d) Mount Med Resort Betriebs GmbH will send an automatic order confirmation to the email address you provided. This confirmation does not constitute acceptance of your order, but merely acknowledges that your order has been received.<\/p>\n

e) A contract between you and Mount Med Resort Betriebs GmbH is concluded only upon our written acceptance of your order (by issuing the invoice) or upon delivery of the goods to you.<\/p>\n

f) If we waive a declaration of acceptance \u2013 such as in cases where delivery of the ordered goods is not possible \u2013 a contract shall not be concluded. In such instances, we will inform you without delay and promptly refund any payment already received, where applicable.<\/p>\n

g) The contractual language shall be German only.<\/p>\n

h) The contract text will not be stored by us following the conclusion of the contract and will not be accessible to you thereafter. However, your order data will be retained by us in accordance with statutory requirements. You may print out the order details immediately after submitting your order via the \u2018Buy\u2019 button in the Mount Med Resort Betriebs GmbH online shop. If you have registered as a user, you may also access your order details at any time under \u2018My Account\u2019 in the Mount Med Resort Betriebs GmbH online shop.<\/p>\n

i) Order processing and shipping are carried out by MYLIFE-CHANGER GmbH. By placing an order, you consent to the transfer of all data necessary for shipping and invoicing to this service provider, and agree that shipment may be handled by MYLIFE-CHANGER GmbH. In addition, MYLIFE-CHANGER GmbH is authorised by Mount Med Resort Betriebs GmbH to carry out collection services. Mount Med Resort Betriebs GmbH remains the invoicing party and the seller of the goods.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>3. Right of Revocation and Cost-Bearing Agreement<\/span><\/a><\/div><\/div>

a) If you are a consumer, you are entitled to the following right of revocation:<\/p>\n

Cancellation Policy<\/p>\n

Customers who are consumers within the meaning of Directive 2011\/83\/EU have the right to withdraw from their contractual declaration within 14 days without giving any reason.<\/p>\n

The cancellation period begins as soon as the customer or a third party designated by them has taken possession of the goods. In the case of a purchase contract for several goods, the cancellation period begins as soon as the customer or a third party designated by them has taken possession of the last partial delivery or the last item. The day on which the period begins is not included in the time limit. Saturdays, Sundays and public holidays are included in the calculation of the time limit.<\/p>\n

To meet the withdrawal deadline, it is sufficient to send the withdrawal declaration or return the goods in a timely manner. To exercise your right of revocation, you must inform Mount Med Resort Betriebs GmbH, c\/o MYLIFE-CHANGER GmbH,
\nTannenberggasse 2\/G1 \u00b7 6130 Schwaz<\/a>, Email: shop@mylife-changer.com<\/a>, by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model cancellation form for this purpose. To adhere to the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the cancellation period expires.<\/p>\n

Consequences of Revocation<\/p>\n

If you withdraw from this contract, Mount Med Resort Betriebs GmbH will reimburse all payments received from you without undue delay and at the latest within 14 days of receiving your notice of withdrawal and the returned goods in undamaged condition, including the original packaging and seal. Unless expressly agreed otherwise, we will use the same method of payment for the refund as you used for the original transaction. You will not incur any fees as a result of this refund. You must return the goods to us without delay, and in any event no later than 14 days from the day on which you informed us of your decision to cancel. The deadline is met if you dispatch the goods before the 14-day period expires.<\/p>\n

Exclusions from the Right of Revocation<\/p>\n

Goods which are not suitable for return due to their nature, may spoil quickly, or are past their expiry date;<\/p>\n

Goods made to customer specifications or clearly tailored to personal requirements;<\/p>\n

Sealed goods which are not suitable for return due to health protection or hygiene reasons and whose seal has been broken after delivery;<\/p>\n

Goods which, after delivery, have been inseparably mixed with other items due to their nature.<\/p>\n

\u2013 End of Cancellation Policy<\/p>\n

We reserve the right to claim compensation for any reduction in the value of the goods if this loss in value results from handling the goods in a manner not necessary to assess their condition, properties or functionality.<\/p>\n

b) Unless otherwise agreed, the right of revocation pursuant to Section 3a) does not apply to long-distance transaction contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery.<\/p>\n

c) If you, as a consumer, exercise your right of withdrawal pursuant to Section 3a), you are responsible for the direct cost of returning the goods, provided the goods delivered match those ordered, and either the price of the item to be returned does not exceed \u20ac40.00; or, at the time of withdrawal, you have not yet made payment or a contractually agreed partial payment for an item of higher value.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>4. Return of Goods<\/span><\/a><\/div><\/div>
\n

a) Mount Med Resort Betriebs GmbH requests that goods returned under the right of revocation be sent to the return address specified in the returns form. The acceptance of returned goods does not constitute acknowledgement of any claimed defects. Please enclose a copy of the invoice with your return to facilitate swift processing.<\/p>\n

b) Your statutory rights, including your right of revocation pursuant to Section 3(a) of these General Terms and Conditions, remain unaffected by the provision set out in Section 4(a).<\/p>\n

<\/i><\/i><\/span>5. Delivery<\/span><\/a><\/div><\/div>
\n

a) Goods are dispatched exclusively to delivery addresses within the Federal Republic of Germany and the Republic of Austria.<\/p>\n

b) Unless otherwise agreed, the delivery period is 2 to 5 working days from receipt of the order. If the final day of this period falls on a Sunday or a public holiday recognised at the delivery location, delivery shall be made on the next working day.<\/p>\n

If delivery is not accepted by the recipient or the goods are not collected from the collection point of the respective carrier, and the goods are returned to MYLIFE-CHANGER GmbH, a handling fee of \u20ac50.00 will be charged. In such cases, MYLIFE-CHANGER GmbH will notify the customer by email. If redelivery is requested, additional shipping costs will apply.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>6. Prices and Shipping Costs<\/span><\/a><\/div><\/div>

a) The prices valid at the time of ordering shall apply.<\/p>\n

b) All prices listed in the Mount Med Resort Betriebs GmbH online shop are stated in euros (EUR).<\/p>\n

c) The final prices indicated in the Mount Med Resort Betriebs GmbH online shop include the applicable VAT.<\/p>\n

d) Any shipping costs will be shown on the order form.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>7. Payment Terms and Payment Methods<\/span><\/a><\/div><\/div>
\n

a) You may pay via PayPal, credit card or instant transfer. PayPal is an online payment service that enables you to pay for purchases quickly and easily. To use this service, you must open a PayPal account at www.paypal.de and link it to your bank account or credit card. If you select PayPal as your payment method, please follow the instructions provided in the Mount Med Resort Betriebs GmbH online shop. Before completing your order, a separate PayPal window will appear, prompting you to authorise the payment. Once PayPal has confirmed receipt of payment, the ordered goods will be dispatched. If you choose to pay by credit card or instant transfer, your credit card will be charged upon completion of the order.<\/p>\n

b) Unless otherwise agreed, the purchase price is payable immediately upon conclusion of the contract.<\/p>\n

c) In the event of delayed payment, we are entitled to charge statutory default interest. If we can demonstrate that greater damage has resulted from the delay, we reserve the right to claim compensation accordingly.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>8. Retention of Title<\/span><\/a><\/div><\/div>

The goods shall remain the property of MYLIFE-CHANGER GmbH until full payment of the purchase price, including all associated costs and expenses, has been made. For business customers, the retention of title extends to all claims arising from the business relationship with Mount Med Resort Betriebs GmbH. In the event of default in payment, even in part, the buyer hereby agrees that we may collect the goods at any time, at their expense. In the event of default, we are entitled to enforce our rights under the retention of title. It is agreed that the enforcement of retention of title does not constitute a withdrawal from the contract, unless expressly stated by us.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>9. Force Majeure and Delivery Adjustments<\/span><\/a><\/div><\/div>
\n

a) If adherence to agreed delivery dates is hindered by circumstances beyond the control of Mount Med Resort Betriebs GmbH \u2013 including, but not limited to, strike, lockout, war and natural disasters \u2013 Mount Med Resort Betriebs GmbH shall be entitled to a reasonable extension of deadlines. In such cases, the customer shall not be entitled to withdraw from the contract or assert any claims due to delay. If the delay results in increased effort or if the cause lies within the customer\u2019s sphere of responsibility, Mount Med Resort Betriebs GmbH shall be entitled to claim compensation for the additional effort incurred.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>10. Warranty and Liability<\/span><\/a><\/div><\/div>
\n

a) For business customers, the provisions of 377 of the Austrian Commercial Code (UGB)<\/a> concerning the obligation to inspect and give notice of defects shall apply.<\/p>\n

b) In the case of delivery by a freight company, it is the customer\u2019s responsibility to inspect the goods thoroughly upon receipt. Once proper delivery has been confirmed, any subsequent complaints regarding defects will not be accepted. If the packaging is damaged, this must be noted on the delivery note at the time of receipt. In the event of a justified and timely complaint, the customer is entitled to either rectification or replacement of the goods by Mount Med Resort Betriebs GmbH. Rectification shall take place at the premises of Mount Med Resort Betriebs GmbH.<\/p>\n

c) The customer must provide proof that the defect existed at the time of handover, indicate when the defect was identified, and confirm that notification of the defect was made in due time.<\/p>\n

d) The following applies to end consumers: If the goods are defective, Mount Med Resort Betriebs GmbH is obliged, at the customer\u2019s discretion, to either rectify the defect or supply replacement goods free from defects. The warranty period is 24 months. After the first 6 months, the customer must provide evidence that the defect already existed at the time of handover. Mount Med Resort Betriebs GmbH reserves the right to refuse the selected form of supplementary performance if it would involve disproportionate costs and the alternative method would not result in significant disadvantage to the customer. If supplementary performance fails, the customer may, at their discretion, withdraw from the contract or request a reduction in the purchase price.<\/p>\n

e) We shall only be liable for slight negligence where essential contractual obligations are breached \u2013 that is, obligations the fulfilment of which enables the proper performance of the contract in the first place, and on which you routinely rely and are entitled to rely. In such cases, our liability is limited to foreseeable damages that typically arise under the terms of the contract. Beyond this, liability for slight negligence is excluded. The above limitations of liability do not apply to damages arising from a breach of warranty; or from injury to life, body or health; nor in cases of intent or gross negligence; or where statutory product liability applies.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>11. Default in Taking Delivery \/ Compensation for Damages<\/span><\/a><\/div><\/div>
\n

a) If the customer fails to accept the goods within a specified period, refuses acceptance, or expressly declares that they will not accept the goods, Mount Med Resort Betriebs GmbH may withdraw from the contract and claim damages for non-fulfilment.<\/p>\n

b) Customer claims for damages \u2013 in particular those arising from delay, impossibility of performance, breach of duty, culpa in contrahendo, defective or incomplete performance, consequential damages due to defects, or unlawful acts \u2013 are excluded unless they are based on intent or gross negligence on the part of Mount Med Resort Betriebs GmbH. The burden of proof for gross negligence lies with the injured party. Any further liability of Mount Med Resort Betriebs GmbH and its vicarious agents is excluded, regardless of the legal basis of the claim, insofar as it is based solely on slight negligence.<\/p>\n

c) The above exclusion of liability does not apply to damages arising from injury to life, body or health, where such damage results from a negligent breach of duty by Mount Med Resort Betriebs GmbH, or from an intentional or negligent breach of duty by a legal representative or vicarious agent. Mount Med Resort Betriebs GmbH shall not be liable for improper use of the goods, or for incorrect assembly by the purchaser where goods are delivered disassembled.<\/p>\n<\/div><\/div><\/div>

<\/i><\/i><\/span>12. Duty to Cooperate<\/span><\/a><\/div><\/div>
\n

The customer is obliged to support Mount Med Resort Betriebs GmbH, its authorised agents and service partners to the best of their ability. In the event of a return shipment, the customer is solely responsible for ensuring the goods are properly packaged. Where possible, the original packaging should be used, or packaging of equivalent quality, to guarantee safe return transport. If goods are delivered by a forwarding agent (the customer will be informed in advance by the forwarding agent), the customer must arrange a delivery date directly with the forwarding agent. If the customer is unable to keep the agreed date and\/or time, they must notify both Mount Med Resort Betriebs GmbH and the forwarding agent. The goods shall be deemed delivered to the customer upon handover to the forwarding agent. From this point onwards, the risk is borne by the customer. It is recommended that the customer takes out appropriate insurance.<\/p>\n<\/div><\/div><\/div>

b) For all disputes arising directly between Mount Med Resort Betriebs GmbH and the customer, the place of jurisdiction shall be the Austrian court with local and substantive jurisdiction at the company\u2019s registered office.<\/p>\n<\/div><\/div><\/div>

If any individual provision of these Terms and Conditions is found to be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In such cases, the invalid provision shall be replaced by a regulation that most closely reflects the economic intent of the original provision.<\/p>\n
